Terms & Conditions

RISE Floorball Academy (ABN 62 631 294 005), a partnership trading in Western Australia (“RISE”, “we”, “us”, “our”).

By registering for, paying for, or participating in any RISE Floorball Academy program, session, clinic, or event, the parent or legal guardian (“you”) and the enrolled participant (“the player”) agree to the following Terms & Conditions. Please read them carefully before completing registration.

1. Registration and enrolment

1.1 Expression of Interest. Registration begins with an Expression of Interest (EOI). Submitting an EOI registers the player for consideration; it does not create a booking, reserve a place, or guarantee selection.

1.2 Selection and allocation. Places are limited. RISE reviews Expressions of Interest and selects and allocates players to sessions based on factors including age group, stage and ability, program numbers, and overall suitability. RISE will notify you whether the player has been offered a place and, if so, in which session.

1.3 Confirming a place. An offered place is confirmed only once full payment has been received by the payment due date. Places that are offered but not paid for by the due date may be released and reallocated.

1.4 You are responsible for ensuring the information provided in your EOI and registration, including the player’s age group, medical details, and emergency contacts, is accurate and kept up to date. Please notify us in writing of any changes.

2. Fees and payment

2.1 Program fees are charged per program. Once a place has been offered, fees are payable in full by the payment due date and prior to the commencement of the program, unless a written alternative arrangement has been agreed with RISE.

2.2 A place may be withdrawn and reallocated where payment has not been received by the due date.

3. Refunds, cancellations and transfers

RISE operates on a no-refund basis once a program has commenced, subject to the exceptions below and to your rights under the Australian Consumer Law (see clause 12).

3.1 Change of mind. Fees are non-refundable where you simply change your mind, or where a player chooses not to attend a session or discontinues part-way through a program for reasons within your control.

3.2 Before the program starts. If you withdraw before the player has attended their first session, you may request a refund of the program fee. RISE may retain a reasonable amount to cover any non-recoverable costs already incurred on the player’s behalf (for example, a shirt or item already ordered or personalised).

3.3 Injury or exceptional circumstances. If, after the program has commenced, the player is unable to continue due to genuine injury, illness, or other exceptional circumstances beyond your control, you may request a refund for the remaining, unused sessions on a pro-rata basis. RISE may ask for reasonable supporting evidence (such as a medical certificate). Sessions already held are not refundable.

3.4 Transfers. A player’s place may be transferred to another eligible player. All transfers must be requested in writing and approved by the RISE team before they take effect. Approval is at RISE’s discretion, and RISE may decline a transfer where the incoming player does not meet the age or eligibility requirements for the program.

3.5 Missed sessions. No refund or credit is provided for sessions a player is absent from, arrives late to, or leaves early from, where the reason falls outside clause 3.3.

3.6 How to request. All refund and transfer requests must be made in writing to [email protected] and will be assessed on a case-by-case basis. Approved refunds are returned via the original payment method.

4. Cancellation or changes by RISE

4.1 RISE may reschedule, relocate, or cancel a session where necessary, for example due to venue availability, coach illness, extreme weather, unsafe conditions, or circumstances beyond our reasonable control.

4.2 Where a session is cancelled by RISE and cannot reasonably be rescheduled or replaced with a make-up session, a pro-rata credit or refund for that session will be offered.

4.3 RISE may make reasonable changes to program times, venues, coaching staff, or session content. We will give as much notice as is practical.

5. Photography, video and media consent

5.1 Photographs and video may be taken during RISE sessions, clinics, and events for coaching, promotional, and record-keeping purposes.

5.2 By registering for a RISE program, you consent to RISE capturing and using photographs and video that include the player across RISE’s channels, including our social media accounts, website, newsletters, printed materials, and other marketing and promotional material.

5.3 RISE will always use images and footage in a manner consistent with the values and positive reputation of the Academy. We will not publish a player’s full name alongside an image without your consent, and we will not sell images to third parties.

5.4 Consent to media use is confirmed at the point of sign-up for each program. If you have concerns about the use of a particular image, or wish to discuss your preferences, please contact us in writing and we will work with you in good faith.

5.5 Access on request. Photographs and video featuring your player can be made available to you on request, where reasonably practical, by contacting [email protected].

6. Code of conduct

6.1 Players are expected to treat coaches, teammates, opponents, officials, and venues with respect, to participate safely, and to follow reasonable instructions from RISE staff at all times. RISE’s values are Respect, Intensity, Skill, and Excellence, and we ask every player to uphold them. If they are not upheld players may be asked to sit out of drills, if behaviour continues a player will be withdrawn from the program with no refund available.

6.2 Parents, guardians, and spectators are expected to be positive and supportive, to refrain from abusive, aggressive, or disruptive behaviour toward players, coaches, officials, or other families, and to follow the rules of any venue we use.

6.3 RISE may issue a warning, suspend, or remove a player or family from a program for serious or repeated breaches of this code, for conduct that endangers the safety or enjoyment of others, or for abusive behaviour toward staff. Where a player is removed for such conduct, fees are not refundable.

7. Health, safety and assumption of risk

7.1 Floorball is a physical, fast-moving sport. Participation carries an inherent risk of injury. By enrolling the player, you acknowledge and accept these ordinary risks.

7.2 You confirm that the player is medically fit to take part, and you agree to disclose at registration any medical condition, injury, allergy, or other matter relevant to the player’s safe participation. It is your responsibility to keep this information current.

7.3 You authorise RISE staff to arrange or administer first aid and, in an emergency where you cannot be contacted, to obtain appropriate medical treatment for the player. You agree to be responsible for any reasonable costs of emergency medical treatment.

7.4 RISE takes reasonable care to provide a safe environment and appropriately supervised sessions. Nothing in these Terms is intended to exclude liability for injury or loss caused by RISE’s negligence, and nothing limits your rights under the Australian Consumer Law.

8. Supervision, drop-off and collection

8.1 RISE is responsible for players only during scheduled session times and within the designated session area.

8.2 Players must be dropped off and collected on time. You remain responsible for the player before and after each session and while travelling to and from the venue.

8.3 If a player is not collected at the end of a session, RISE staff will attempt to contact you using the emergency contacts provided.

9. Equipment and property

9.1 Players should bring appropriate footwear and any equipment specified for the program. RISE-supplied equipment must be treated with care and returned where required.

9.2 RISE is not responsible for loss of or damage to personal property brought to sessions or venues, except to the extent caused by our negligence.

10. Communication

10.1 RISE communicates with enrolled families by email and through a private WhatsApp group for confirmed participants. Invitations to the group are issued only to families who have completed registration and payment.

10.2 Group messaging is provided for program-related communication. We ask that it be used respectfully and for its intended purpose.

11. Privacy

11.1 RISE collects personal information (including contact, medical, and emergency details) solely to run its programs safely and to communicate with families. We handle personal information in accordance with the Australian Privacy Principles.

11.2 We do not sell personal information. We share it only where necessary to deliver our programs (for example, with coaching staff) or where required by law.

11.3 You may request access to, or correction of, the personal information we hold about your family by contacting [email protected].

12. Australian Consumer Law

12.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

12.2 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. The no-refund provisions in clause 3 apply to change-of-mind and similar situations and do not limit your statutory rights where a service is not provided with due care and skill or is otherwise not as described.

13. Liability

13.1 To the extent permitted by law, and subject to clauses 7.4 and 12, RISE’s liability arising from participation in its programs is limited to the resupply of the relevant service or the cost of resupplying it.

13.2 RISE is not liable for loss or injury caused by a participant’s failure to follow reasonable safety instructions, or by a pre-existing condition that was not disclosed.

14. Changes to these Terms

14.1 RISE may update these Terms from time to time. The current version will be made available at registration and on our website. The Terms that apply to you are those in effect at the time you register for a given program.

15. Governing law

15.1 These Terms are governed by the laws of Western Australia, and the parties submit to the jurisdiction of the courts of that State.
